In January 2022, a new Condominium law came into force in Portugal. One of the new requirements is the new statement on condominium fees for the property sale, which will go into force on April 10, 2022.
Since April 2022, the owner who wants to sell his property in Condominium must provide the buyer with a certificate issued by the Condominium Administration. The requirement to provide this certificate is mandatory in all property deeds (sale and grant) and in the setting up of a mortgage.
This certificate must mention whether or not there are any unpaid quotas, specifying the exact amounts and the deadlines by which they should have been paid.
The condominium management must also state the amount and deadline for payment of the dues in force on the date of the deed of sale of the property.
The owner who sells the property is entitled to receive the certificate from the Condominium Administration within 10 days of requesting it.
The buyer can exempt the seller from providing this certificate at the deed. In this case, the buyer takes full responsibility for the payment of all unpaid fees by the seller. According to Portuguese law, the Condominium Management may demand the payment of the unpaid quotas up to a maximum period of 5 years.
